These General Conditions of Use (Terms) govern access to and use of the Onyma Pro mobile application, published by Maia Delhumeau, established in France (KALEI APPT 104, 12 CRS DE QUEBEC, 33300 Bordeaux) and operated in Morocco.
Purpose
Onyma Pro is a business management and growth solution intended for professionals in the beauty and wellness sector (hair salons, spas, barbers, institutes, etc.). It provides, among other things, appointment management, client management, service management and activity tracking.
Acceptance of the Terms
Installing the application and creating an account constitutes full and unreserved acceptance of these Terms. Users who do not accept all or part of the Terms must refrain from using the service.
Registration and Account
Access to the service requires the creation of a professional account. Users undertake to provide accurate, up-to-date information and to keep their credentials confidential. Any use of the account is deemed to be made by its holder, who remains responsible for all actions carried out through it.
User Obligations
Users undertake to use the service for its intended professional purpose, in compliance with applicable regulations and these Terms. In particular, they must refrain from any fraudulent use, any attempt to compromise the security of the service, any submission of unlawful content and any use of their clients' data that breaches applicable data protection regulations.
Subscriptions and Payment
Certain features of the service are available through a paid subscription. Prices, duration and the content of each plan are specified in the application before any purchase. Unless stated otherwise, subscriptions are billed in advance and are not refundable pro rata in the event of cancellation during a billing period.
Intellectual Property
The application, its structure, content, trademarks, logos and graphic elements are protected by intellectual property law and remain the exclusive property of the publisher. Any unauthorized reproduction, representation or exploitation, in whole or in part, is prohibited. Data entered by users remains their property.
Liability
Onyma Pro makes every effort to provide a reliable, high-quality service, without however guaranteeing the total absence of errors or interruptions. The publisher cannot be held liable for indirect damages, data loss attributable to the user, or malfunctions caused by the network, the user's equipment or force majeure.
Service Availability
The service is in principle available 24/7. Occasional interruptions may nevertheless occur for maintenance, updates or security reasons. The publisher strives to keep them as short as possible and, where feasible, to inform users in advance.
Termination
Users may stop using the service and request deletion of their account at any time. The publisher reserves the right to suspend or terminate access to the service, after notification, in the event of a serious or repeated breach of these Terms or fraudulent use of the service.
Changes to the Terms
The publisher may amend these Terms at any time, in particular to reflect changes to the service or to applicable regulations. Users will be informed of any substantial change; continued use of the service constitutes acceptance of the amended Terms.
Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute that cannot be resolved amicably, jurisdiction is granted to the competent French courts, subject to any mandatory provisions applicable in the place where the service is operated.
